Advertising review

BUILD THE BRAND.
PROTECT THE CLAIM.

Could your online marketing be doing your business more harm than good?

Build the brand. Protect the claim. A contractor’s website marked for review. Do not let a regulator be the first person to audit your website.

Your website is not just content.
It is a collection of claims.

Choose a question. Open the details.

CAN YOU PROVE IT?

Support what you advertise.

Can you substantiate every advertised claim? Are your licenses, certifications, testimonials and advertised results presented accurately?

Check the promises on your website, social posts, truck lettering and printed materials. Does the evidence support what a customer will understand?

The FTC requires a reasonable basis for objective advertising claims before they run.

GUARANTEED… WHAT?

Make the promise clear.

Do you offer a SATISFACTION GUARANTEE? Are its conditions and limitations clearly disclosed?

What is covered? For how long? What must the customer do? What happens if the customer is dissatisfied?

A money-back guarantee does not replace evidence supporting an advertising claim.

WHAT COULD IT COST?

TDLR administrative penalties

UP TO$5,000

PER DAY FOR EACH VIOLATION

Texas Occupations Code §51.302 sets this maximum for a TDLR-regulated program when its governing law does not specify another maximum. Each day a violation continues or occurs is a separate violation.

The applicable law, violation and enforcement criteria determine the penalty. This is not an automatic fine for every website error or a rule covering every Texas contractor.

BEFORE YOU PUBLISH.

An extra set of eyes.

That is not just a seal. That is ongoing advertising support.

Once Accredited, you can send new advertisements, guarantees, promotions and marketing campaigns to me for advertising review before publishing them.

Would you rather identify a problem before it is published, or after a customer, competitor or regulator finds it?

Protect the claim before you publish it.

HOW DO I START?

Start with your business.

Pay nothing unless your business is approved. If claims require modification or substantiation during the Heart of Texas application review, you will be advised before approval. You are not charged while those issues are being addressed.

We will review the applicable Accreditation fees and terms together before you apply.
